Welcome to our Terms of Service

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "Host", "Invitation Creator") and Eventic ("we", "us", "our"), governing your access to and use of the Eventic platform, website, and all related services (collectively, the "Platform"). By registering for an account, creating an invitation, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and all policies incorporated herein by reference, including the Privacy Policy, Refund Policy, and Payment Policy. If you do not agree to these Terms, you must immediately discontinue use of the Platform.


These Terms apply to all users worldwide. Where local laws impose additional obligations or grant additional rights, those local law provisions shall apply to the extent required.



1. Definitions


  1. "Platform" means the Eventic website, web application, APIs, and any associated digital services operated by Eventic.
  2. "User" means any individual or entity that accesses or uses the Platform, whether or not registered.
  3. "Host" / "Invitation Creator" means a registered User who creates one or more digital invitations using the Platform.
  4. "Guest" means any individual who receives, accesses, or responds to a digital invitation created through the Platform.
  5. "Invitation" means a digital event invitation created, customised, and distributed by a Host using the Platform's tools and templates.
  6. "Uploaded Content" or "User Content" means all data, files, text, images, photographs, audio tracks, video files, graphic assets, and any other material submitted, uploaded, or published by a User on or through the Platform.
  7. "Intellectual Property Rights" means all patents, copyrights, neighbouring rights, performing rights, moral rights, trade marks, service marks, trade dress, trade secrets, database rights, rights of publicity, and all other intellectual and proprietary rights, whether registered or unregistered, in any jurisdiction worldwide.
  8. "Paid Features" means any premium template, feature add-on, extended validity period, or other service available on the Platform for a charge, as further described in the Payment Policy.
  9. "Free Tier" means the limited set of features and templates available to Users at no charge, subject to the usage limits described in the Payment Policy.


2. Account Registration & Security


  1. To access certain features of the Platform, you are required to create an account. You must provide accurate, current, and complete information during registration and keep your account information updated at all times.
  2. You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You must not disclose your credentials to any third party.
  3. You are fully responsible and liable for all activities that occur under your account, whether or not authorised by you. You must notify Eventic immediately at security@eventic.in upon becoming aware of any actual or suspected unauthorised access to your account.
  4. Eventic reserves the right to refuse registration, suspend, or terminate any account at its sole discretion, including where Eventic reasonably suspects the account is being used in violation of these Terms or applicable law.
  5. Each registration is for a single User only. You may not share account access with others or create accounts on behalf of third parties without their express authority.


3. Permitted Use of the Platform


Subject to your compliance with these Terms, Eventic grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for lawful personal or internal business purposes — specifically, to create, customise, distribute, and manage digital event invitations.


You agree that you shall not, and shall not permit any third party to:


  1. Use the Platform for any purpose that is unlawful, fraudulent, deceptive, or harmful, or in any manner that damages the reputation of Eventic or any third party;
  2. Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform or its content without Eventic's prior written consent;
  3. Attempt to gain unauthorised access to any part of the Platform, its systems, networks, or data;
  4. Interfere with or disrupt the integrity or performance of the Platform or data contained therein;
  5. Use automated scripts, bots, crawlers, or scraping tools to access or collect data from the Platform;
  6. Upload or transmit Uploaded Content that is unlawful, defamatory, obscene, pornographic, harassing, threatening, or otherwise objectionable;
  7. Create invitations for events, activities, or purposes that are illegal, deceptive, or violate the rights of any person;
  8. Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  9. Harvest, collect, or store personal information of other Users without their express consent;
  10. Engage in any activity that imposes an unreasonable or disproportionate load on the Platform's infrastructure.


4. Uploaded Content & User Responsibility


4.1 Ownership


You retain all ownership rights to the Uploaded Content you submit to the Platform. By uploading Content, you grant Eventic a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, process, display, and distribute your Uploaded Content solely to the extent necessary to provide the Platform's services to you. This licence terminates when your Uploaded Content is deleted from the Platform.


4.2 User Warranties


By uploading any Content to the Platform, you represent and warrant that:


  1. You own the Content or have obtained all necessary rights, licences, consents, and authorisations to upload and use it on the Platform;
  2. The Content does not infringe upon any Intellectual Property Rights of any third party;
  3. The Content does not violate any applicable law, regulation, or third-party rights;
  4. You have obtained any and all consents required under applicable privacy laws from any individuals whose personal data or likeness appears in the Content.

4.3 Eventic's Right to Remove Content


Eventic reserves the right — but not the obligation — to review, moderate, edit, or remove any Uploaded Content at any time and without prior notice, where Eventic reasonably believes such Content violates these Terms, infringes any third-party right, or is otherwise objectionable or unlawful. Eventic shall not be liable for any loss or inconvenience resulting from the removal of Uploaded Content.



5. Intellectual Property & Copyright


5.1 Eventic's Intellectual Property


The Platform and all of its original content, features, functionality, design, templates created by Eventic, source code, trade marks, service marks, logos, and trade dress are and shall remain the exclusive Intellectual Property of Eventic and its licensors, protected by applicable copyright, trade mark, and other intellectual property laws worldwide. Nothing in these Terms transfers any Intellectual Property Right in the Platform or its materials to you.


5.2 Copyright Responsibility for Music, Video, and Media Uploads


The Platform provides Users with the technical capability to incorporate audio tracks ("Music"), video files ("Video"), photographs, graphical assets, and other creative media (collectively, "Uploaded Media") into their digital invitations.


Eventic is not a licensor, distributor, or publisher of any Uploaded Media. Eventic provides solely the technical infrastructure for upload and playback and assumes no responsibility whatsoever for the intellectual property status, licensing compliance, or lawfulness of any Uploaded Media.


Each User who uploads Music, Video, or any other media to the Platform expressly acknowledges and agrees that:


  1. The User — as Host or Invitation Creator — is solely and exclusively responsible for ensuring that any Music, Video, or other media they upload is either (a) owned by them in its entirety, or (b) used under a valid, subsisting licence from the applicable copyright holder(s), performing rights organisation(s), music publisher(s), record label(s), and/or any other rights holder, as required under applicable law in every jurisdiction in which the invitation is distributed or accessed.
  2. The User is solely responsible for obtaining and maintaining, at their own expense, all necessary synchronisation rights, master recording rights, public performance licences, mechanical licences, and any other rights required for the lawful incorporation and use of Music or Video within the invitation.
  3. Eventic is not responsible for, and expressly disclaims all liability in connection with, any claim, demand, action, lawsuit, fine, penalty, or other consequence arising out of or related to the copyright, licensing, or ownership of any Uploaded Media, including claims brought by music publishers, performing rights societies, collecting societies, record labels, individual artists, visual content creators, or any other rights holder.
  4. Eventic shall not be liable for any takedown obligation, licence fee, royalty payment, or damages arising from the User's failure to obtain proper rights clearances for Uploaded Media.
  5. The User shall indemnify, defend, and hold harmless Eventic and its officers, directors, employees, contractors, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, judgements, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to any breach of the warranties set out in this Section 5.2.

Eventic reserves the right, in its sole discretion and without liability, to remove or disable access to any Uploaded Media upon receipt of a valid copyright infringement notice, court order, or regulatory directive, in accordance with applicable law (including the Digital Millennium Copyright Act (DMCA) in the United States, and equivalent takedown procedures under EU Directive 2019/790 and other applicable jurisdictions).


5.3 Copyright Infringement Notices (DMCA & Global Equivalents)


If you believe that any Uploaded Content on the Platform infringes your copyright, please submit a written notice to legal@eventic.in containing:


  1. Identification of the copyrighted work claimed to have been infringed;
  2. Identification of the infringing material and its location on the Platform;
  3. Your name, address, telephone number, and email address;
  4. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law;
  5. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the copyright owner.


6. Payment, Subscriptions & Pricing


The Platform operates on a freemium model. Certain templates and features are available at no charge within defined usage limits (including RSVP functionality for up to fifty (50) guests free of charge). Paid templates, Paid Features, and extended validity periods are available at the applicable charges set out in the Payment Policy, which is incorporated into these Terms by reference.


The total cost of a Paid Invitation is determined by two primary factors: (a) the validity duration selected by the Host (i.e., the number of days the invitation will remain active), and (b) the features selected by the Host during the creation process. A full pricing breakdown is presented at checkout prior to payment confirmation.


All payments are subject to the Payment Policy and Refund Policy, both of which are incorporated into these Terms by reference. In the event of any conflict between these Terms and the Payment Policy or Refund Policy with respect to financial matters, the Payment Policy and Refund Policy shall prevail.



7. Disclaimers & Limitation of Liability


7.1 "As Is" Basis


The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Eventic does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.


7.2 Limitation of Liability


To the maximum extent permitted by applicable law, Eventic and its officers, directors, employees, agents, affiliates, and licensors shall not be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, or the cost of substitute services, arising out of or in connection with your use of or inability to use the Platform, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory.


In jurisdictions that do not permit the exclusion or limitation of liability for certain types of damages, Eventic's liability shall be limited to the maximum extent permitted by applicable law. In no event shall Eventic's aggregate liability to you arising from or related to these Terms or your use of the Platform exceed the greater of: (a) the total amount paid by you to Eventic in the three (3) months immediately preceding the claim, or (b) one hundred Indian Rupees (₹100).


7.3 Third-Party Services


The Platform may integrate with or provide links to third-party services, websites, or applications. Eventic is not responsible for the content, privacy practices, or availability of such third-party services. Your interactions with third-party services are governed entirely by those third parties' terms and conditions.



8. Indemnification


You agree to indemnify, defend, and hold harmless Eventic and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:


  1. Your use of or access to the Platform;
  2. Your violation of these Terms;
  3. Your violation of any third-party right, including any Intellectual Property Right or privacy right;
  4. Any Uploaded Content you submit to the Platform, including any claim that your Uploaded Media infringes the copyright or other Intellectual Property Rights of a third party;
  5. Your breach of any representation or warranty made in these Terms;
  6. Any event you organise, promote, or distribute invitations for via the Platform.


9. Term & Termination


  1. These Terms are effective from the date you first use the Platform and continue until terminated by you or Eventic.
  2. You may terminate your Account at any time by following the account deletion process within the Platform settings or by contacting contact@eventic.in.
  3. Eventic reserves the right to suspend or terminate your access to the Platform, with or without notice, at any time and for any reason, including but not limited to breach of these Terms, violation of applicable law, fraudulent activity, or conduct that is harmful to Eventic, its users, or third parties.
  4. Upon termination, your licence to use the Platform ceases immediately. Eventic will handle your data in accordance with the Privacy Policy. Termination does not extinguish any obligation or liability accrued prior to termination, including outstanding payment obligations.
  5. Provisions of these Terms that by their nature should survive termination shall do so, including Sections 5 (Intellectual Property), 7 (Disclaimers), 8 (Indemnification), 10 (Governing Law), and 11 (Dispute Resolution).


10. Governing Law & Jurisdiction


These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Notwithstanding this, Eventic acknowledges that Users located in other jurisdictions may have rights under their local laws that cannot be contractually excluded, and nothing in these Terms shall be construed to limit any such mandatory rights.


For Users located in the European Economic Area or the United Kingdom, mandatory consumer protection laws and data protection laws of your country of residence shall apply to the extent required.


For Users located in the United States, applicable federal law and the laws of the state in which you reside may provide additional rights that are not displaced by this Agreement.



11. Dispute Resolution


11.1 Informal Resolution


Before initiating any formal dispute proceedings, you agree to first contact Eventic at legal@eventic.in to attempt to resolve the dispute informally. Eventic will use reasonable efforts to resolve the dispute within thirty (30) days of receiving the notice.


11.2 Arbitration


If a dispute cannot be resolved informally, any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be finally settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), as amended. The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, or appointed in accordance with the rules of a recognised arbitral institution. The language of arbitration shall be English, and the seat of arbitration shall be India.


11.3 Class Action Waiver


To the maximum extent permitted by applicable law, you waive any right to participate in a class action lawsuit or class-wide arbitration against Eventic.



12. Modifications to These Terms


Eventic reserves the right to update or modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by notifying you via the Platform or by email. Your continued use of the Platform after the effective date of any amended Terms constitutes your acceptance of the revised Terms.



13. General Provisions


  1. Entire Agreement: These Terms, together with the Privacy Policy, Payment Policy, and Refund Policy (all incorporated by reference), constitute the entire agreement between you and Eventic with respect to the Platform and supersede all prior or contemporaneous agreements, representations, and understandings.
  2. Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
  3. Waiver: No failure by Eventic to enforce any provision of these Terms shall constitute a waiver of Eventic's right to enforce such provision or any other provision in the future.
  4. Assignment: You may not assign or transfer your rights or obligations under these Terms without Eventic's prior written consent. Eventic may freely assign its rights and obligations under these Terms.
  5. Force Majeure: Eventic shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, acts of government, war, terrorism, strikes, pandemics, or failures of third-party infrastructure.
  6. Language: These Terms are drafted in the English language. In the event of any conflict between an English version and a translated version, the English version shall prevail.
